GS1 UK solution check service

Customer terms and conditions for the solution check compliance review service.

1. Interpretation

In these Terms and Conditions (“Terms”):

GS1 UK GS1 UK Ltd, the provider of the Solution Check Service
Customer Individual or organisation requesting the Solution Check Service
Solution Check Service or Service GS1 UK service which provides structured reviews, guidance, and recommendations on compliance with GS1 standards for products, solutions, or processes
Report Written findings and recommendations provided to the Customer by GS1 UK following completion of the Service
Order Form Form completed by the Customer to request the Service
Fees Charges for the Solution Check Service, as set out in the Order Form or published pricing

2. Provision of Service

2.1 The Service provides a structured review of the Customer’s product, solution, or process for compliance with GS1 standards, along with guidance and recommendations. 

2.2 The Service may include, as applicable: review of documentation, demonstration, sample checks, and provision of a written Report. 

2.3 The Service does not include ongoing support, public certification, or endorsement unless expressly stated. 

2.4 GS1 UK will use reasonable endeavours to provide the Service within any indicated timeframes, but time shall not be of the essence. 

2.5 The findings and recommendations in the Report are based solely on the information, documentation, and samples provided at the time of the review. Any subsequent changes by the Customer may invalidate the Report. 

2.6 It is the Customer’s responsibility to ensure ongoing compliance with current GS1 standards after the Service is completed.

3. Customer Obligations

3.1 The Customer shall provide all information, documentation, access, and cooperation reasonably required by GS1 UK to deliver the Service.

3.2 The Customer warrants that all information provided is true, accurate, and complete. GS1 UK shall not be liable for any results or recommendations based on inaccurate, incomplete, or misleading information.

3.3 The Customer is responsible for ensuring that any samples or materials submitted to GS1 UK do not infringe any third-party rights and are not hazardous.

3.4 The Solution Check Service does not provide the Customer with any public accreditation, certification, or endorsement by GS1 UK. The Customer may not represent or imply that receipt of the Service or Report constitutes such accreditation or certification.

4. Fees

4.1 The Customer agrees to pay the Fees as set out in the Order Form or published pricing prior to delivery of the Service.

4.2 Fees are payable in advance. GS1 UK is not obliged to provide the Service until payment has been received.

4.3 All Fees are exclusive of VAT, which shall be payable at the prevailing rate.

4.4 No refunds will be given once the Service has commenced, except as required by law.

5. Cancellation

5.1 In the event that the Customer wishes to cancel the Service, it can do so at any point by notifying GS1 UK.

5.2 Where the Service is cancelled in accordance with clause 5.1, no refund to any Fees paid or payable will be made.

6. Suspension

6.1 GS1 UK reserves the right to suspend the Service, where:

6.1.1 at GS1 UK’s sole discretion, the acts and omissions of the Customer have or may damage the goodwill and/or reputation of GS1 UK;

6.1.2 at GS1 UK’s sole discretion, the Customer has not used the Service in accordance with these Terms;

6.1.3 scheduled or unscheduled maintenance is required (as determined by GS1 UK);

6.1.4 there is an attack or severe issue which affects the Service;

6.1.5 the Customer has failed to pay the Fees;

6.1.6 GS1 UK reasonably believes that there has been, or could be, an incident of unauthorised access to the Service, through the Customer’s account.

7. Termination

7.1 This agreement, unless terminated earlier in accordance with these Terms, shall end upon the completion of the Service.

8. Consequences on Termination

8.1 Upon termination of this agreement:

8.1.1 access to the Service and all data provided shall immediately cease;

8.1.2 all outstanding Fees shall become immediately payable.

9. Limitation of Liability

9.1 The liability of GS1 UK in connection with the Service and/or these Terms to the Customer whether in contract, tort (including negligence), breach of statutory duty or otherwise shall not exceed an amount, in aggregate, equal to 150% of the Fees that are paid by the Customer for the Service in the 12 months preceding the claim.

9.2 GS1 UK shall not be liable for any delayed, partial or total non-performance of the Service arising directly or indirectly from any event outside GS1 UK’s control including failure by the Customer to comply with any of its obligations hereunder.
